Yarburgh church was rebuilt in 1405 after a fire so is something of interest as it is one of the few churches in the area built solely of one period. The design is of the Perpendicular Style and quite striking primarily due to the castellated tower.

I TRIED TO FIND A MARRIAGE LICENSE ON JOHN AND GEORGIA BUT ACCORDING TO THE TENNESSEE STATE LIBRARY & ARCHIVES THERE IS A GAP IN THEIR MARRIAGE RECORDS FOR HARDIN COUNTY, TN BETWEEN SEPT 1869 AND NOVEMBER 1874. THIS MARRIAGE DATE WAS GIVEN TO ME BY JOHN THOMAS’S GRANDDAUGHTER, VADA DEARMOND FROM HER RESEARCH.

JOHN THOMAS WAS A SHERIFF OR A SHERIFF’S DEPUTY IN HARDIN COUNTY AND HAD TO GO OUT INTO A FIELD WHERE A MAN WAS PLOWING TO ARREST HIM. THE MAN VOWED THAT NO MAN COULD ARREST HIM. HE REFUSED AND RESISTED ARREST. HE GRABBED A BREAST YOKE FROM THE HARNESS ON THE HORSES TO HIT JOHN THOMAS WITH. IN SELF DEFENSE, JOHN T SHOT AND KILLED HIM. HIS LAST NAME WAS MAYBERRY OR NEWBERRY. THE MAN HAD RELATIVES, EITHER SONS OR BROTHERS WHO VOWED THEY WOULD KILL JOHN T. SO BECAUSE OF THIS, JOHN LEFT TENNESSEE AND CAME TO OKLAHOMMA UNDER COVER OF NIGHT.
HIS WIFE AND CHILDREN LATER LEFT HOUSE AND ALL BELONGINGS, TOOK A TEAM AND WAGON AT NIGHT AND WENT TO TRAIN DEPOT, BOARDED THE TRAIN, LEAVING TEAM AND WAGON STANDING. SHE HAD JOHN ROBERT, MARY DOSHA, CHARLEY GARFIELD, LAURA JEFFERSON, MYRTLE GOZELL, AND POSSIBLEY EDDIE EUGENE. DURING THEIR MOVING AROUND FROM PLACE TO PLACE THEY HAD ODIS THOMAS, AND MILLARD FILLMORE. THEY ENDED UP WEST OF ADA, OKLAHOMA WERE GEORGIA ANN DIED NOVEMBER 17, 1894 GIVING BIRTH TO MELISSA.

THIS STORY IS NOT VERIFIABLE, BUT TOLD TO ME IN 1950 BY MY GRANDFATHER, MILLARD YARBROUGH.
SAMBO–WHILE LIVING IN COCHISE COUNTY IN 1974, I BOUGHT A HORSE NAMED SAM (A PROUD GELDING) AND PAID $100.00 FOR HIM WITH TACK INCLUDED. UNKNOWN TO ME, IN ARIZONA, ONE MUST GET A TITLE WITH A PHOTO OF THE HORSE ON THE HORSE I.D. CARD. I ONLY RECEIVED A BILL OF SALE. I SOLD SAM ONE YEAR LATER TO A MAN IN BISBEE, AND HIS SON FELL OFF THE HORSE AND WAS HOSPITALIZED WITH A BROKEN LEG. THE COUNTY HUMANE OFFICER (DEPUTY SHERIFF) WROTE ME A TICKET FOR SELLING A HORSE WITHOUT A TITLE AND SAID THAT I WAS A HORSE THIEF. I TOLD HIM THAT MY MOTHER’S NAME WAS YARBROUGH AND I WAS JUST CARRYING ON THE FAMILY TRADITION. THE COURT CLERK THEN DISMISSED THE CHARGE.
JOHN DIDN’T MARRY AGAIN UNTIL 1903 WHEN HE MARRIED MINNIE BELL LOKEY
JOHN THOMAS OWNED A FERRY ON THE NORTH CANADIAN RIVER ON SCHOOLTON ROAD IN 1907. HIS DRIVER WAS J.H. HARRELL AND HELPER FRANK ATCHLEY. A PICTURE IS HANGING IN THE HISTORICAL SOCIETY MUSEUM IN OKEMAH, OKLAHOMA. I ASKED THE LADY AT THE MUSEUM IF WE COULD GET A COPY OF THE PICTURE. SHE SAID SHE WOULD ASK THE PERSON THAT DONATED THE PICTURE AND IF IT WAS OK WITH HIM, SHE WOULD HAVE ONE MADE AND MAIL IT TO US. ABOUT A WEEK LATER WE RECEIVED THE PICTURE IN THE MAIL.
IN 1908 HE MOVED TO ASHLAND WHERE HE AND CHARLEY GARFIELD RAN A LARGE MERCHANDISE STORE. THEY WERE DOING REALLY WELL THERE. JOHN AND MINNIE HAD A REALLY NICE HOUSE.
JOHN THOMAS AND HIS FAMILY AND GARFIELD AND HIS FAMILY WENT TO NEW MEXICO TO FIND WORK. IT WAS A LONG HARD TRIP, ESPECIALLY WITH KIDS. THE KIDS WERE ALWAYS FIGHTING EACH OTHER. VURNA AND MINNIE GOT INVOLVED AND THATS WHEN THEY DECIDED THEY DIDN’T CARE MUCH FOR EACH OTHER EITHER.
THEY LEFT NEW MEXICO AND CAME BACK TO OKEMAH, OKLAHOMA. JOHN ROBERT STAYED OUT THERE.
JOHN & MINNIE OPENED A GROCERY STORE IN OKEMAH, OKLAHOMA.
JOHN ALSO RAN A STORE IN LAMAR, OKLAHOMA.

THIS POND IS WHERE JOHN WAS BAPTISED ABOUT THREE YEARS BEFORE HE DIED. HE WAS BAPTISED BY GLEN JEFFREY FROM THE CHURCH OF CHRIST.
JOHN WAS LIVING WITH EDDIE AND DOVIE ON TATE MOUNTAIN SOUTH WEST OF WEWOKA, OKLAHOMA. THEY WAS RENTING A HOUSE FROM DEWEY HUCKABEE AT THE TIME. IT WAS LOCATED EAST OF TATE MOUNTAIN CEMETERY. THE FIRST ROAD AFTER YOU LEAVE THE CEMETERY GOING EAST. TURN SOUTH AND GO 3/10 MILE. THE HOUSE WAS ON THE RIGHT SIDE OF THE ROAD. MILLARD YARBROUGH HAD COME FROM CALIFORNIA TO VISIT. THERE WERE SEVERAL FAMILY MEMBERS THERE VISITING. IT WAS MARCH 28, 1940. SEVERAL OF THEM WERE IN THE KITCHEN PLAYING MUSIC. MILLARD CAME IN TO THE LIVING ROOM AND SAID PAPA JUST DIED. THEY LAID HIM ON A BOARD AND COVERED HIM WITH A SHEET UNTIL THE NEXT MORNING. UNCLE BILL CHOATE AND ALVIN DOUGLAS SHAVED HIM. BUCHANAN FUNERAL HOME FROM HENRYETTA, OKLAHOMA, NOW SHURDAN FUNERAL HOME, BROUGHT THE BURIAL CLOTHES THE NEXT DAY.
JOHN THOMAS IS BURIED AT TATE MOUNTAIN CEMETERY IN WEWOKA, OKLAHOMA.
TATE IS IN EASTERN SEMINOLE COUNTY, 6 MILES SOUTH OF WEWOKA. IT HAD A POST OFFICE FROM JUNE 1, 1903, TO NOVEMBER 30, 1906. IT WAS NAMED FOR H.M. TATE, ATTORNEY AND UNITED STATES COMMISSIONER.
JOHN THOMAS ALWAYS WENT BY J.T. YARBROUGH. ACORDING TO VADA DEARMOND HIS FULL NAME WAS JOHN THOMAS JEFFERSON YARBROUGH. THEY WERE NAMEING THEIR KIDS AFTER PRESIDENTS BACK THEN AND THOMAS JEFFERSON WAS PRESIDENT WHEN HE WAS BORN.

GEORGIA ANN AND MELISSA WERE BURIED IN THE SAME GRAVE AT OLD MOSS CEMETERY IN VANOSS, OKLAHOMA. THE CEMETERY IS LOCATED OFF HIGHWAY 19 WEST OF ADA, OKLAHOMA. IT IS ABOUT ONE AND A HALF MILES BACK UP IN A PASTURE THAT IS NOW, 1997, OWNED BY MR. & MRS. AUTI MCCULLAR. IT’S IN PONTOTOC COUNTY. LEGAL DESCRIPTION OF THE LAND IS MIDLAND TWP, R-4-E, SEC. 2 SOUTH OF THE BRIDGE CROSSING BARRIS CREEK. THEY HAVE A NICE TOMBSTONE. THE GRAVE HAS ABOUT A 6-8 INCH WIDE CEMENT SQUARE AROUND IT. THERE IS A SMALL SQUARE STONE ON ONE SIDE OF THE GRAVE AT THE FOOT THAT HAS THE INITIALS “IY” ON IT AND ANOTHER JUST LIKE IT ON THE OTHER SIDE OF THE GRAVE AT THE FOOT THAT HAS “GY” ON IT. IT IS ALL GROWED UP WITH TREES, WEEDS, AND BRIARS, BUT THE TOMBSTONE IS STILL IN GOOD SHAPE.
MAY 7, 1998 WE MOVED GEORGIA ANN AND MELISSA FROM OLD MOSS CEMETERY TO TATE MOUNTAIN CEMETERY WHERE JOHN THOMAS IS BURIED.
THE MOVE WAS HANDLED BY ATTORNEY GREGORY S. TAYLOR OF ADA, OKLAHOMA AND BILL STITTSWORTH OF CHRISWELL FUNERAL HOME IN ADA, OKLAHOMA.

MR. STITTSWORTH TOOK CARE OF EVERY DETAIL AND EVERY THING WENT AS PLANNED. HE DID AN EXCELLENT JOB.
THE COUNTY OF WEWOKA, OKLAHOMA DUG THE GRAVE. I DON’T KNOW THE MANS NAME BUT HE WAS VERY NICE AND HELPFUL.
THEY FOUND SEVERAL PIECES OF HER REMAINS AND PIECES OF THE COFFIN OF MELISSA. MELISSA DIED A FEW DAYS AFTER GEORGIA ANN AND THEY HAD BURIED HER 41/2 FEET DEEP IN THE SAME GRAVE WITH GEORGIA ANN.

SHE WAS THE SECOND WIFE OF JOHN THOMAS.
MINNIE AND JOHN WERE MARRIED IN HAGAR, POTTAWATOMIE COUNTY, OKLAHOMA TERRITORY. THEY WERE MARRIED BY D.L. ALEXANDER, A MINISTER OF THE GOSPEL OF THE BAPTIST CHURCH OF HAGAR, OKLAHOMA TERRITORY. THEIR WITNESSES WERE W.J. NEWMAN & L.S. POWELL OF HAGAR. ON THE AFFIDAVIT ON APPLICATION FOR MARRIAGE LICENSE, L.S. POWELL SIGNED THE APPLICATION SWEARING THAT HE WAS ACQUAINTED WITH J.T. AND MINNIE AND THAT J.T. WAS 47 YEARS OLD AND NOT MARRIED AND MINNIE WAS 27 YEARS OLD AND NOT MARRIED. THE MARRIAGE APPLICATION WAS OBTAINED ON JANUARY 30, 1903 WITH PROBATE CLERK M.T. NORRIS SIGNING THE APPLICATION.

GRAVESIDE SERVICES WERE HELD JUNE 20, 1943 AT 2:30 P.M. AT WARDS CHAPEL CEMETERY IN ATOKA, OKLAHOMA WITH REV. C.M. MCMILLAN OFFICIATING. KEITH & SONS FUNERAL HOME WAS IN CHARGE. SAMUEL DIED IN OKLAHOMA CITY AT UNIVERSITY HOSPITAL AFTER SEVERAL MONTHS OF ILLNESS FROM AN ARTERIAL CLEROTIE HEART DISEASE. CERTIFYING PHYSICIAN WAS DR. DALE. HE HAD RESIDED IN THE STATE OF OKLAHOMA SINCE 1903.
WE FOUND HIS TOMBSTONE IN WARDS CHAPEL CEMETERY. IT HAS INITIALS ON IT OF T.M. YARBROUGH. HE WAS NOT BURIED BY HIS WIFE. THEIR INFANT DAUGHTER, BESSIE, IS BURIED NEXT TO HER. SAMUEL IS BURIED QUITE A WAYS FROM THEM.
SAMUEL’S GRAND DAUGHTER, HELEN INTEMANN, SENT ME A COPY OF A PARDON FOR SAMUEL. THIS GAVE ME A LEAD TO FIND OUT MORE ABOUT WHAT HAPPENED.
SAMUEL THOMPSON YARBROUGH WAS SENT TO PRISON FOR MANSLAUGHTER. HE WAS CONVICTED JULY 26, 1913. I OBTAINED A NEWSPAPER CLIPPING WITH THE TESTIMONY OF WITNESSES AND OF SAMUEL’S ( T.M.) TESTIMONY. IT IS VERY LENGTHLY AND I CANNOT INCLUDE THE ENTIRE ARTICLE, HOWEVER, BELOW IS SAMUEL’S OWN TESTIMONY, AS TO WHAT HAPPENED, AS THE NEWSPAPER REPORTED IT:
TESTIMONY OF THE DEFENDANT
MY NAME IS T.M. YARBROUGH, I AM THE DEFENDANT IN THIS CASE. I WILL BE 44 YEARS OLD ON THE 7TH DAY OF SEPTEMBER. I WAS BORN IN ALABAMA, NEAR RUSSELVILLE. I LEFT THERE WHEN I WAS YOUNG. I HAVE NEVER BEEN IN JAIL BEFORE. I CAME TO THIS COUNTRY IN 1894. I FIRST MOVED TO ARDMORE. I AM A FARMER. I HAVE BEEN IN ATOKA COUNTY NEARLY THREE YEARS, AND LIVE NINE MILES WEST OF HERE, OR SOUTH WEST, RATHER. I HAVE A LEASE ON DAVE BETTS’ PLACE. I HAVE LIVED IN PITTSBURG COUNTY, AT ASHLAND, AND HAVE A WIFE AND FOUR CHILDREN. I WORKED AT WHAT IS KNOWN AS EDGAR’S SAW MILL. I WENT TO WORK THERE BETWEEN THE 15TH AND 20TH OF SEPTEMBER LOGGING, AND STAYED THERE UNTIL THE 13TH OF JANUARY. I WANTED TO LEAVE BEFORE I DID AND MADE THREE OR FOUR EFFORTS TO LEAVE. I HAD SOME TROUBLE WITH MR. LANDRUM ON THE MORNING OF THE 13TH DAY OF JANUARY. I REMEMBER EVERYTHING THAT OCCURRED AT THAT TIME. I THINK I REMEMBER IT ALL. IT WAS ABOUT 12 O’CLOCK THAT MORNING. THE DIFFICULTY OCCURRED IN THE LOT RIGHT BACK OF THE HOUSE. THE LOT IS ALITTLE WEST OF MY HOUSE ABOUT 30 STEPS I GUESS. THERE WAS A LOG WAGON IN THE LOT, RIGHT IN FRONT OF THE GATE, AND WHEN I WENT OUT THERE, THERE WERE MR. REAVES AND ALBERT ARTHUR AND MR. LANDRUM AND A YOUNG FELLOW NAMED JOHNNY HOLMAN. ALBERT ARTHUR WAS STANDING AT THE BACK END OF THE LOT. MR. REAVES WAS STANDING BETWEEN ME AND MY HOUSE. LANDRUM WAS STANDING FROM OFF THE HIND WHEEL OF THE WAGON AT THE RIGHT SIDE OF THE COUPLING POLE. HOLMAN CAME IN AFTER I GOT THERE AND STEPPED RIGHT IN ON THE OTHER SIDE OF ME. MR. LANDRUM ASKED HOLMAN WHY IT WAS THAT HE DID NOT GO TO WORK, AND DAVE TOLD HIM THAT HE COULD NOT FIND WHERE THE BOYS’ WERE WORKING. I SPOKE UP AND SAID, IF HE HAD GONE RIGHT UP TO ALBERT’S HOUSE, I DIDN’T SEE HOW HE COULD MISS IT; HE SAID, “I FOOLED AWAY ALL MORNING GETTING UP ON THE MOUNTAIN AFTER A LOAD-OF LOGS,” AND I TURNED TO ALBERT ARTHUR AND SAID; “ARE YOU GOING TO LOG HERE FOR $3 A THOUSAND AND BE HALF A DAY GETTING ON TO THE MOUNTAIN TO GET A LOAD OF LOGS,” AND HE SAID, “I DON’T HAVE TO, AND I AINT GOING TO PUT ANOTHER LOG ON MY WAGON FOR $3 A THOUSAND,” MR. LANDRUM SPOKE UP AND SAID, “THERE ARE MEN THAT WILL DO IT,” AND I SAID, “I KNOW THAT, AND IF I CAN GET MY MONEY I WILL LEAVE HERE THIS EVENING,” AND HE SAID “YOU CAN SURE GET IT,” AND I SAID, “YOU CAN’T GIVE IT TO ME TOO QUICK.” I SAID, “MR. EDWARDS AGREED TO PAY ME BY THE 10TH AND HERE IT IS THE 13TH AND NOBODY KNOWS WHERE HE IS.” AND HE SAID, “THAT IS A GOD DAMN LIE,” AND I SAID “YOU HAVE NO RIGHT TO CALL ME A LIAR; YOU DIDN’T HEAR WHAT WAS SAID AND I HAVE A WITNESS TO SHOW THAT HE SAID THAT.” WHEN HE TOLD ME IT WAS A DAMN LIE, I TOLD HIM I HAD A WITNESS TO PROVE THAT HE TOLD ME THAT. I SAID IT IS NOT THE FIRST TIME. I SAID THE MONTH BEFORE THAT, HE TOLD ME THE SAME, THAT HE WOULD HAVE IT BY THE THIRD, AND HE SAID ALL I HAD TO DO WAS MAKE OUT MY TIME AND GO TO ED ROGERS AT STRINGTOWN. I GOT IT THAT MONTH ON THE 23RD. WHEN I TOLD HIM THAT EDGAR AGREED TO HAVE MY MONEY THERE ON THE 3RD HE SAID “THAT IS ANOTHER GOD DAMN LIE.” AND WHEN HE CALLED ME A GOD DAMN LIAR THE SECOND TIME I PICKED UP A CHOPPING AXE THAT WAS ON THE GROUND IN FRONT OF ME, AND I WENT TO THE LEFT HIND WHEEL OF THE WAGON AND LANDRUM WAS STANDING IN FRONT OF THE RIGHT HIND WHEEL, BETWEEN THE WHEEL AND THE COUPLING POLE; WHEN HE CALLED ME A LIAR THE SECOND TIME, I PICKED UP THE CHOPPING AXE AND I SAID, “YOU CAN’T CALL ME A DAMN LIAR WHEN I AM TELLING YOU THE TRUTH; I WILL CHOP YOUR DAMN HEAD OFF.” WHEN I PICKED UP THE AXE HE CAME AROUND THE WHEEL AND STARTED OUT THE GATE, AND WHEN HE STARTED, I THREW DOWN THE AXE AND I TOLD HIM TO STOP. HE DIDN’T STOP, AND I SAID THE SECOND TIME, “STOP; YOU AINT GOING TO MAKE NO GUN PLAY ON ME; THAT WILL NOT WORK.” BEFORE THAT TIME I KNEW MR. LANDRUM’S REPUTATION FOR BEING A QUARRELSOME, TURBULENT, AND OVERBEARING MAN AND HAD HEARD WHEN HE HAD TROUBLE HE WAS BAD AND HAD A BAD DISPOSITION. WHEN I TOLD HIM TO STOP THE SECOND TIME, HE JUMPED BACK OF A PINE TREE; IT WAS RIGHT AT THE GATE; IT WAS FASTENED TO THE GATE. WHEN I PICKED UP THE AXE HE GOT A CLAW HAMMER RIGHT THERE, AND I DON’T KNOW WHAT HE DID WITH IT. WHEN I LAID THE AXE DOWN I WALKED OUT BY THE GATE. HE WAS AT THE TREE AND I HAD THE PISTOL STILL IN MY POCKET. I GOT THIS PISTOL FROM BOB STAFFORD ABOUT TWO MONTHS BEFORE THAT. HE LIVES ABOUT A MILE SOUTH OF THE MILL. I CARRIED IT IN MY POCKET A MONTH WITHOUT ANY CARTRIDGES IN IT. I HAD BEEN CARRYING IT FOR TWO MONTHS. THE TRIGGER SPRING BROKE AND IT WOULD NOT CATCH, AND MR. LANDRUM’S LITTLE BOY AND MY LITTLE BOY HAD BEEN BUSTING MATCHES IN IT. I USED TO RUN A SHOE SHOP AND WAS GOING TO FIX IT. I HAD IT ON A NAIL AND THE BOYS GOT IT AND MR. CLARK HAD SOME CARTRIDGES THAT WOULD FIT IT AND I HAD TO CARRY IT IN MY POCKET TO KEEP THE CHILDREN FROM IT. I WAS AFRAID THEY WOULD GET THERSE CARTRIDGES OR SOMETHING. I HAD NO PLACE AT THE HOUSE. I HAD NO TRUNKS WITH ANY LOCKS. I HAD IT IN MY POCKET TO KEEP THEM FROM IT. YOU COULD SHOOT IT ONE TIME WITH THE TRIGGER WITHOUT PULLING THE HAMMER BACK; YOU HAD TO TAKE YOUR FINGER AND PUSH THE TRIGGER FORWARD AND THEN YOU COULD SHOOT AGAIN. THE HAMMER WILL STAY COCKED IF YOU PULL IT BACK EASY AND PUSH ON THE TRIGGER. I HAD IT IN MY FRONT POCKET. THAT IS THE PISTOL THERE (EXAMINING’ IT). IT IS JUST LIKE I HAD IT WHEN I GAVE IT TO THE SHERIFF. THAT IS THE COAT I HAD ON THAT DAY. I WALKED OUT ABOUT THREE STEPS AND TURNED AROUND AND MY INTENTION WAS NOT TO HAVE A FUSS. I LOOKED HIM IN THE FACE AND HE LOOKED LIKE HE COULD EAT ME UP. I HAD NO MORE THAN A GOOD LOOK AT HIM TILL HE STRUCK AT ME TWICE, THAT WAY (INDICATING), AND THE SECOND TIME HE STRUCK ME. I SAW SOMETHING LIKE A KNIFE BLADE AND I GRABBED HIS ARM AND MY HAND SLEPPED OFF. AS HE GRABBED I STARTED TO GET THE GUN OUT; I INTENDED TO HIT HIM WITH IT AND KEEP HIM OFF, AND WHEN I GOT IT OUT HE GRABBED MY HAND AND GOT MY FINGERS LIKE THAT (INDICATING FINGERS AROUND GUN), AND AS HE JERKED THE GUN FIRED. JUST AS I GRABBED HOLD OF THE GUN THAT WAY HE GRABBED MY HAND WITH HIS LEFT HAND, AND I JERKED TO KEEP HIM FROM GETTING IT. MY HAND WENT OVER HIS NECK AND HE GRABBED THE GUN WITH THE OTHER HAND AND ABOUT THE TIME HE STRUCK IT WITH HIS RIGHT HAND, IT FIRED, AND AS IT FIRED HE DROPPED TO HIS KNEES. I BRACED MYSELF AND CAUGHT IT BY THE MUZZLE AND TOOK IT OUT OF HIS HAND AND SAID, “DAMN IT, YOU CAN’T TAKE A GUN AWAY FROM ME,” AND STUCK IT IN MY POCKET. MR. LANDRUM GOT UP AND STARTED TOWARD HIS HOUSE AND GOT HALF WAY BEFORE I KNEW WHAT WAS GOING ON. THAT MORNING I HAD NOT HAD ANYTHING TO EAT. MY CONDITION WAS STARVATION; I HAD SLEPT SCARCELY ANY THE NIGHT BEFORE. MR. LANDRUM WAS THE SAWYER AND FOREMAN. THE FOREMAN HAD CHARGE OF THE MILL. I HAD NOT HAD ANY TROUBLE WITH MR. LANDRUM BEFORE THAT. MY COAT WAS CUT. THAT IS ONE OF THEM THERE (SHOWING JURY). I TORE THAT WITH MY THUMB IN PUTTING IT ON, AND THERE IS THE OTHER CUT. THE COAT IS IN THE CONDITION IT WAS AFTER THE TROUBLE. I GAVE IT TO MR. RAY THE SHERIFF. WHEN HE GRABBED THE GUN. I DIDN’T KNOW HE WAS SHOT. THE FIRST TIME I KNEW IT WAS WHEN I NET THIS LITTLE BOY ABOUT HALF WAY TO DAISY.

I WAS WORKING FOR MR. EDGAR AT THE MILL AND HIRED TO HIM. I WAS LOGGING BY THE THOUSAND. I HAD BLOCKED FOR HIM SOME. WHEN I GOT THERE, THERE WAS NO LOG WAGON AND I HAD A THREE-QUARTER BAIN WAGON, AND HAD IT CUT DOWN WITH LOW WHEELS. I GOT MY CHECK FROM ROGERS, WHO PAID FOR MR. EDGAR. I CARRIED THIS PISTOL TO KEEP THE CHILDREN FROM GETTING IT. I DID NOT LOAD IT TO KEEP THEM FROM GETTING IT. I CAME TO ATOKA ABOUT THREE OR FOUR WEEKS BEFORE, AND BOUGHT TEN CAARTRIDGES AT STRINGTOWN. I HAD IT LOADED TWO OR THREE WEEKS. I DID NOT SAY “MR. LANDRUM, IF YOU GO OUT OF THAT GATE I WILL KILL YOU,” OR THAT IN SUBSTANCE. I DID NOT SAY “I WILL SHOOT YOU.” HE SAID, “BOYS DON’T LET HIM SHOOT ME.” AND IF ALBERT ARTHUR OPENED HIS MOUNTH I DON’T KNOW IT. AS I WALKED BY HE LUNGED AT ME AND JUMPED ON ME BEFORE I KNEW WHAT HE WAS DOING. I PULLED MY GUN AFTER HE GOT TO ME. WHEN THE QUESTION CAME UP ABOUT THE WORK I SAID, “EDGAR HAS NOT DONE WHAT HE AGREED TO DO; HE IS A MAN THAT YOU COULD NOT DEPEND ON WHAT HE SAID AND THAT I WOULD NOT STAY WITH AN OUTFIT LIKE THAT; A MAN WAS NO ACCOUNT WHO DID NOT CARE ANYTHING FOR HIMSELF OR FAMILY IF HE DID.” AFTER THE GUN WENT OFF I WENT TO THE HOUSE. I STAYED THERE UNTIL MR. LANDRUM TURNED BACK AND THEN I PICKED UP A GUN AND STARTED TO DAISY AFTER MY BOY. I DID NOT GO TO DAISY. I WENT NEARLY THERE. I WENT ON FOOT TO ASHLAND, TO MY BROTHERS. I WENT THE MAIN ROAD ABOUT HALF WAY. I STAYED WITH MY BROTHER TILL THE NEXT EVENING AND GOT TO HIS HOUSE ABOUT 4 O’CLOCK NEXT MORNING. I KNEW I HAD SHOT HIM WHEN I MET TULLOS, HIS LITTLE BOY. I SAYED AT MY BROTHER’S TILL THAT EVENING AND THEN WENT TO MY NEPHEW’S SIX MILES NORTH EAST OF ASHLAND. I GAVE MYSELF UP TO MR. REAL, CONSTABLE AT ASHLAND. MR. LANDRUM, AT ANY TIME, NEVER OWED ME ANY MONEY HIMSELF THAT I REMEMBER OF. I NEVER WORKED FOR MR. LANDRUM EXCEPT AS HE WAS THE FOREMAN. MR. EDGAR OWNED THE MILL. I BOUGHT GOODS FROM MR. CLARK AT DAISY ON A CREDIT. I ALWAYS PAID HIM. HE REFUSED ME ONE TIME, THE DAY THIS TROUBLE OCCURRED. I WONED A MULE TEAM AT THE TIME THAT I HAD BEEN OFFERED THREE HUNDRED CASH FOR IN THE SPRING. THEY WERE MORTGAGED TO THE BANK AT TUSHKA FOR $ 343.33. I HAVE NEVER BEEN CONVICTED OF A FELONY. I REMEMBER NOW BETTER THAN WHEN I MADE THAT AFFIDAVIT. THE REASON IS THAT THEN MY FAMILY WAS IN NEED; HAD NOTHING TO GO ON AND HAD NOTHING TO EAT, AND I WAS BOTHERED AND MY MIND WAS NOT RIGHT. IT IS ALL RIGHT NOW. MY MIND WAS NOT RIGHT THE DAY THE TROUBLE OCCURRED. I WAS IN A SUFFERING CONDITION. I DIDN’T HAVE A BITE OF FOOD NOR HAD NY FEED FOR MY TEAM. MY CONDITION WAS STARVATION. IT WAS BECAUSE MY CHILDREN WERE WANTING SOMETHING TO EAT. I COULD NOT CONTROL MYSELF, AND I WAS NERVOUS. I HAD NOT BEEN SICK. I COULD NOT CONTROL MY ACTION OR MY WORDS AND FELT WRONG. I WOULD START TO DO SOMETHING AND FORGET WHAT IT WAS AND HAVE TO STOP AND THINK WHAT I STARTED TO DO. I REMEMBER A LITTLE OF WHAT OCCURRED THEN. IT SEEMS LIKE A DREAM. I WAS RESTLESS. THE REASON WAS FOR LACK OF MEANS. I HAD NOT A BITE IN THE HOUSE FOR MY WIFE AND CHILDREN AND NO MONEY TO GET IT WITH.
I HAD MADE AN EFFORT TO GET VIETUALS. I HAD MADE AN EFFORT TO GET MEAT. HAD MADE AN EFFORT AT EVERY FAMILY AT THE CAMP, I GUESS; ABOUT EVERYONE. WE HAD JUST BREAD AND MIGHTY LITTLE OF THAT. AND POURED IN A LITTLE WATER AND IN THE FRYING PAN WITHOUT ANY GREASE. I DIDN’T HAVE ANY DINNER. THEY OWED ME SIXTY-FOUR DOLLARS AND SOME CENTS. MY OLDEST CHILD IS 14, WILL BE THE 6TH OF SEPTEMBER, AND THE YOUNGEST ONE LIVING IS ABOUT TWO YEARS OLD.

SAMUEL WAS IN LITTLE ROCK ARKANSAS IN 1899. HE HAD A CHILD, WILLIAM LEWIS, THAT WAS BORN THERE IN THAT YEAR. HE MOVED TO ATOKA COUNTY ABOUT 1910.
SAMUEL CHANGED HIS NAME TO T.M. YARBROUGH, AND WENT BY THE NAME OF TOM OR THOMAS, SOMETIME BETWEEN 1880 AND 1913. APPARENTLY THERE WAS AN APPEAL AND IT TOOK THAT LONG BEFORE HE ACTUALLY HAD TO ENTER PRISON. HE SAYS ON THIS DOCUMENT THAT HE HAS 6 CHILDREN. IN ADDITION TO THE 4 CHILDREN LISTED, HE HAD TWO CHILDREN DIE AS INFANTS AND IS BURIED IN ROCK CREEK CEMETERY IN WELEETKA, OK.

WHILE STILL YOUNG, MYRTLE CAME WITH HER FAMILY TO OKLAHOMA WHERE SHE MET AND MARRIED JOHN THOMAS HARPER AT WEWOKA, OKLAHOMA. THE FAMILY LIVED IN LOCO, OKLAHOMA., BEFORE GOING TO WELLINGTON, TEXAS. THEY LIVED IN TEXAS FOR ALMOST 40 YEARS.
MYRTLE GOZELLE HARPER DIED IN ST. JOSEPH’S HOSPITAL IN WELLINGTON, COLLINGSWORTH COUNTY, TEXAS AT THE AGE OF 82. SHE HAD SUFFERED A BROKEN HIP ABOUT 3 WEEKS BEFORE SHE DIED OF CEREBRAL HEMORRHAGE, AFTER 10 DAYS, AS AS RESULT OF CEREBRAL ARTERIOSCLEROSIS THAT SHE HAD FOR YEARS. SHE WAS BURIED OCTOBER 13, 1967 IN NORTH WELLINGTON CEMETERY, IN WELLINGTON, TEXAS. FUNERAL SERVICES WAS CONDUCTED AT 2:00P.M. AT THE FIRST BAPTIST CHURCH BY THE REV. LEROY GASTON, PASTOR, ASSISTED BY THE REV. DEWEY HORTON OF AMARILLO. BURIAL WAS UNDER THE DIRECTION OF JAMES H. KELSO OF KELSO FUNERAL HOME. INFORMATION WAS GIVEN TO THE FUNERAL HOME BY MRS. VERNON RUDY. MYRTLE WAS PRECEEDED IN DEATH BY HER HUSBAND TOM HARPER.

TOM & MYRTLE RAISED WILLIAM LLOYD HARPER’S DAUGHTER, PATSY HARPER, FOR THREE YEARS UNTIL HER DAD RE-MARRIED. PATSY SAID SHE WAS A VERY SPECIAL GRANDMOTHER. SHE WAS QUITE A LARGE WOMAN AND SHE WOULD CRAWL UP IN HER LAP AND SAY “GRANDMA TELL ME ABOUT WHEN YOU WERE A LITTLE GIRL.” SHE SAID MYRTLE WAS QUITE A TOMBOY. SHE LOVED OUTDOORS AND HORSES. AFTER MYRTLE’S MOTHER, GEORGIA ANN, DIED SHE HAD TO HELP IN THE HOUSE AND SHE DIDN’T LIKE THAT MUCH. TOM & MYRTLE WERE VERY STRONG CHRISTIAN PEOPLE AND TAUGHT HER TO BE A GOOD CHRISTIAN PERSON. PATSY THOUGHT HER GRANDFATHER, TOM, WAS THE BEST MAN SHE EVER MET. MYRTLE WAS GOOD TO HER ALSO. MYRTLE HAD A TINY WICKED SIDE TOO. SHE DIPPED SNIFF, BUT COULDN’T STAND TO SEE A WOMAN SMOKE.

ODE (ODIS) DIED OF 3 GUNSHOT WOUNDS, ONE IN THE HEAD, ONE IN THE STOMACH, AND ONE IN THE MOUTH. THE BULLET WHICH STRUCK HIM IN THE MOUTH APPARENTLY WAS FIRED AS HE FELL OR AFTER HE HAD FALLEN, SINCE IT RANGED DOWNWARD EMERGING FROM BETWEEN HIS SHOULDERS. HE WAS SHOT JULY 7, IN SCHULTER, OKLAHOMA WITH A 22 CALIBER RIFEL BY R.J. REINHART.
REINHART WAS 23 YEARS OLD AND A WPA TRUCK DRIVER.
THE ALTERCATION BROKE OUT AT ODE’S HOUSE ABOUT 2:00 A.M. ACCORDING TO IDA YARBROUGH, ODE’S DAUGHTER IN LAW, R.J. CAME OVER DRUNK AND WANTED ODE TO GO DRINKING WITH HIM. ODE WOULDN’T GO, SO R.J. GOT MAD AND POURED A BUCKET OF WATER ON HIM WHILE HE WAS STILL IN BED. ODE GOT MAD AND THREW HIM OUT. HE SAID HE WOULD GO HOME AND GET HIS GUN AND COME BACK AND KILL HIM, WHICH HE DID. ODE WAS TAKEN TO HENRYETTA HOSPITAL WHERE HE UNDERWENT EMERGENCY SURGERY. ODE DIED TWO DAYS LATER IN HENRYETTA HOSPITAL. DR. BOLLINGER ATTENDING.

R.J. REINHART WAS CHARGED WITH MURDER IN CONNECTION WITH THE SHOOTING. ACCORDING TO IDA YARBROUGH, HE (R.J.) DID NOT SPEND VERY MUCH TIME IN JAIL FOR THE SHOOTING.
R.J. CAME TO WHERE IDA WORKED AND WANTED TO TALK TO ORVIL. SHE LET HIM FOLLOW HER HOME. WHEN THEY ARRIVED ORVIL ASKED WHY SHE HAD BROUGHT HIM THERE. SHE TOLD ORVIL HE WANTED TO TALK TO HIM. ORVIL TURNED TO R.J. AND ASKED HIM WHAT HE WAS DOING THERE AND HE SAID HE ONLY HAD ONE THING TO SAY. ORVIL TOLD HIM TO SAY IT AND GET OUT. R.J. TOLD ORVIL HE KNEW HE PROBABLY WOULDN’T DO IT BUT HE WANTED TO ASK FOR HIS FORGIVENESS. ORVIL ASKED HIM HOW HE THOUGHT HE COULD FORGIVE HIM FOR KILLING HIS FATHER AND TOLD HIM TO GET OUT. THEY HAVEN’T HEARD FROM HIM SINCE.

ODE WAS IN A BAR AND THERE WAS THIS BIG MUSCULAR GUY WALKING AROUND SAYING HE WAS A BEAR. HE JUST KEPT ON SAYING IT. ODE WALKED OVER AND TAPPED HIM ON THE SHOULDER AND SAID “ARE YOU A BEAR?” THE MAN ANSWERED YES. ODE SAID “WHAT KIND OF BEAR ARE YOU?” THE MAN ANSWERED “A TEDDY BEAR.” THE MAN THEN SHUT UP.

WHEN MILLARD WAS ABOUT 13 OR 14 YEARS OLD HE BOUGHT A LITTLE PEARL HANDLED PISTOL AND WAS VERY PROUD OF IT. HE WAS RIDING ON THE FERRY WITH HIS DAD, JOHN THOMAS, AND SHOWED IT TO HIM. JOHN THOMAS ASKED HIM WHAT HE PAID FOR IT AND SOME OTHER QUESTIONS ABOUT IT. HE THEN TOLD MILLARD THAT IT LOOKED LIKE A PRETTY NICE LITTLE GUN AND THAT HE HAD GOTTEN IT FOR A GOOD PRICE. THEN JOHN THOMAS JUST TOSSED IT OVER THE SIDE OF THE FERRY INTO THE WATER. HE THEN TOLD MILLARD THAT PISTOLS WERE FOR SHOOTING PEOPLE AND THAT HE DIDN’T NEED ONE. OF COURSE THIS MADE MILLARD PRETTY MAD.

A BLIND MULE–IN 1930 MY GRANDFATHER, MILLARD YARBROUGH WAS CULTIVATING COTTON WITH A BLIND MULE AND A TWO-ROW CULTIVATOR. THE BLIND MULE KEPT STEPPING OVER INTO THE NEXT ROW AND MY GRANDFATHER KEPT BEATING THE MULE FOR BEING WRONG. IN FACT, GRANDFATHER WAS INCORRECT BECAUSE HE WAS IN THE WRONG ROW AND CUT DOWN ALL THE COTTON. WHEN MY GRANDFATHER REALIZED THAT HE WAS WRONG, HE UNHITCHED THE BLIND MULE AND GAVE IT A DAY OFF AND FED THE POOR ANIMAL OATS AND SORGHUM.
